All service and equipment rental reservations offered by Migoria L.L.C. must be made through authorized and secure methods, preferably through our official website. Online payments are processed through trusted and encrypted platforms, ensuring the protection of the client’s personal and financial information.

The client declares that all information provided during the payment process — including card details, personal identification, name, and address — is true, complete, and up to date.

Accepted Payment Methods:

– Online payments through the website using debit or credit card, including:

• Visa

• Mastercard

• American Express (Amex)

• Discover

• Other cards accepted by our secure payment platform

– Zelle, by sending the payment to the company’s official email address. Payments made through Zelle will receive a 3% discount applied to the total reservation amount.

– PayPal, by sending the payment directly from their app to Migoria’s official account.

– Venmo, by sending the payment directly from their app to Migoria’s official account.

– Cash App: payments via Cash App are accepted only if made from the available balance or a linked bank account. Payments made with a card through Cash App are not accepted, as they incur an additional fee that must be covered by the client.

– Cash: cash payments are also accepted. In this case, if the client wishes to secure a reservation, payment must be made in person and in advance, on a previously agreed date, prior to the reserved event.

Migoria does not guarantee equipment availability without prior payment.

Reservation Confirmation:

Reservation confirmation will depend on the payment method used:

– If payment is made through the website:

The reservation will be automatically confirmed once the payment is completed, as the client will have accepted the Terms and Conditions and electronically signed the contract during the online booking process.

– If payment is made outside the website (via Zelle, PayPal, Venmo, Cash App, or cash):

The reservation will only be considered confirmed when the following two conditions are met:

1. The client has completed the full payment through one of the accepted methods.

2. The client has read and electronically signed the service contract with the Terms and Conditions, which will be sent via email after the booking request.

Migoria L.L.C. reserves the right to withhold equipment availability until both steps have been fully completed.

At Migoria L.L.C., we understand that unforeseen circumstances may arise. For this reason, we have established a clear and fair policy regarding cancellations and refunds for our equipment rental services.

Cancellation

– Clients may cancel their reservation up to three (3) days prior to the scheduled event date in order to receive a full refund of the amount paid for the equipment reservation.
– If the cancellation is made less than three (3) days in advance, the payment made will be considered non-refundable under any circumstances.

– If the client cancels within the permitted timeframe, the refund will be issued in full and without penalties.
– The refund will be processed only to the same payment method used in the original transaction.
– This refund applies to the amount paid for the equipment reservation and any related charges, except for the security deposit (which is covered under a separate policy).
– Migoria L.L.C. is not responsible for any delays in the refund process caused by banks, payment platforms, or third-party institutions.

To protect all rented equipment, Migoria L.L.C. requires a security deposit to be provided on the day of the event, whether:
– Migoria L.L.C. delivers the equipment to the agreed location, or
– The client picks up the equipment personally.

This deposit is mandatory and serves as a safeguard in case of damage, breakage, loss, theft, vandalism, or any other incident that may affect the condition of the equipment during the rental period.

How much is the deposit?

The deposit amount is calculated based on the total value of the rented equipment or package and will range between 10% and 30% depending on the type of equipment and associated risk level.

How is the deposit paid?

The deposit must be provided on the day of the event using one of the following payment methods:
– Cash
– Zelle

Deposits cannot be paid through the website. The deposit must be submitted directly, either in person or through one of the accepted applications.

When is it refunded?

The deposit will be fully refunded after the event if:
– All rented equipment is returned or picked up in good condition, without any damage or missing parts.
– Migoria L.L.C: confirms that all items are in the same condition as when they were delivered.

Penalties for Late Return or Delayed Pickup

All equipment must be ready for return or pickup within the agreed timeframe specified in the reservation contract.

– Migoria L.L.C. delivers equipment at 9:30 a.m. and collects it at 8:00 a.m. on the scheduled date. This schedule applies whether Migoria L.L.C. is responsible for picking up the equipment from the client’s location or the client returns the equipment directly to Migoria’s warehouse.

– If the client delays the return of the equipment or fails to have it disassembled and available at the agreed pickup time, Migoria L.L.C. reserves the right to withhold part of the deposit as a penalty for operational disruption or delays.

– This applies whether the client is responsible for returning the equipment or if Migoria L.L.C. is scheduled to retrieve it.

Migoria L.L.C. reserves the right to partially or fully withhold the deposit in any of the following cases:

Migoria L.L.C. offers transport services for the delivery and pickup of rented equipment, with rates based on the distance from our operations base in Hamilton, Ohio.

Free Delivery

– Delivery and pickup are completely free for clients located within a 0 to 10-mile radius from our base.

Transportation Costs by Distance

– From 10 to 15 miles:
• $25 will be charged for delivery and $25 for pickup.
• If the client chooses to personally handle either the delivery or the return, a discount will be applied for the unused service.
– From 15 to 20 miles:
• $40 will be charged for delivery and $40 for pickup.
• If the client chooses to personally handle either the delivery or the return, a discount will be applied for the unused service.

Transport Payment Method

The transport fee must be paid on the same day of the event, along with the security deposit. Accepted payment methods:
– Cash
– Zelle
– PayPal
– Venmo
– Cash App
Please note: Cash App payments are only accepted when paid from an available balance or bank account. Card payments are not accepted due to additional fees, which must be covered by the client.

This charge is non-refundable, as it corresponds to a service provided.

Relation to the Security Deposit

– The security deposit applies strictly to the rented equipment.
– The deposit amount (ranging from 10% to 30%) is calculated only on the total value of the rented equipment, not including transport costs.
– Transport charges are handled separately and are not included in the refundable deposit.

Customer Pickup Option

– All clients, regardless of distance, have the option to pick up and/or return the rented equipment themselves if they prefer.
– This option is available both in free delivery zones and in areas where delivery fees apply.

Migoria L.L.C. will coordinate delivery or pickup details with the client in advance, including scheduling and specific requirements to ensure a smooth, efficient, and punctual process.

Migoria L.L.C. offers transportation of all rented equipment to the client’s location and scheduled pickup after the event. Alternatively, clients may choose to pick up and return the equipment themselves. In such cases, Migoria L.L.C. will provide professional-grade packing materials and handling instructions to ensure that all items are transported safely. The client agrees to use these materials and follow all instructions to prevent any damage, scratches, or breakage during loading, transport, or unloading. Any damage resulting from improper handling or failure to follow the provided guidelines will be subject to deduction from the security deposit and, if necessary, additional charges.

Consequences of Failing to Pay for Transportation

If the client fails to make the required transportation payment on the day of the event, it will be considered a breach of contract, resulting in the following consequences:
– Immediate cancellation of equipment delivery or pickup, as applicable.
– Full forfeiture of the security deposit if it was already provided.
– Penalty charges and/or operational cost recovery, which may be directly charged to the payment method used by the client during the reservation, including debit cards, credit cards, or other registered payment methods.
– Potential legal or collection actions, if necessary.

Any failure to comply with the conditions outlined in these Terms and Conditions, as signed and accepted by the client, shall constitute a direct breach of the service agreement with Migoria L.L.C. This includes, but is not limited to:

– Refusing to pay for the agreed transportation service.
– Refusing to provide the required security deposit on the day of the event.
– Failing to return the rented equipment within the time and manner previously agreed upon.
– Any other serious violation of the terms that were previously accepted by the client.

Consequences of Breach

In the event of a breach, Migoria L.L.C. reserves the right to:
– Immediately cancel the reservation, with no right to a refund.
– Withhold any previously made payments, including the full reservation amount.
– Apply penalties or compensation charges for damages or losses, which may be directly charged to the payment method provided by the client during the reservation process, including credit cards, debit cards, or any other registered payment method.
– Pursue legal or collection actions if necessary.

Legally Binding Agreement

By completing a reservation and accepting the Terms and Conditions, the client acknowledges having read, understood, and voluntarily accepted this agreement. Any breach will be treated as a contractual violation, and Migoria L.L.C. reserves the right to take appropriate action to protect its interests, including legal measures if required.

Migoria L.L.C. delivers all rental equipment and items in optimal condition and ready for use, and provides, when applicable, a user manual or clear instructions to ensure proper handling by the client.

In addition, visible warning signs are placed on or near the equipment when necessary, with clear safety indications such as hot surfaces, electrical cables, trip hazards, or other potential risks. These signs are intended to help prevent accidents and reinforce safety during the event.

All electrical equipment rented by Migoria L.L.C. is backed by the required technical certifications to ensure safe use by clients. Similarly, our tents carry appropriate structural and material safety certifications, in full compliance with industry standards for use in events.

For tent setups, Migoria L.L.C. provides professional and secure installation, carried out by trained personnel certified in OSHA safety standards, TRD (Tent Rental Division) practices, and fully familiar with the manufacturer’s technical manuals. This ensures every tent is properly and securely installed for safe use throughout the event.

Once the equipment has been delivered to the client’s location or picked up from Migoria’s operating point, the company shall be completely released from all liability, including but not limited to:
– Damages, losses, breakage, theft, vandalism, or misuse of the equipment.
– Equipment malfunctions due to improper handling or negligence after delivery.
– Injuries, accidents, or incidents involving guests or third parties during the event.

The client assumes full responsibility from the moment the equipment leaves Migoria’s custody, and agrees to use the items properly, safely, and in accordance with the instructions, warning labels, and certifications provided.

Migoria L.L.C. shall not, under any circumstance, be held liable for legal claims, demands, or actions resulting from the use of the equipment during the rental period, as all items are delivered in safe, functional, and compliant condition with all necessary safety measures clearly communicated.
